Terms of Service

Service terms

These Terms govern bgp43.net, a non-commercial Free IP Transit project supported by Hop179.net, AS213449.net, Lynqia and Lungu Stefan. Service is provided to approved networks only. There is no SLA, no uptime guarantee and no commercial support commitment.

1. Service nature

  • bgp43.net provides free fair-usage IP Transit over tunnels for approved networks only.
  • Project owner: Vladyslav.
  • The project is operated as a free non-commercial community service.
  • The service may include GRE, SIT, VXLAN, WireGuard, BGP sessions, route filtering, monitoring and related dashboard functions.
  • Nothing on this site creates a commercial carrier, telecom, hosting, managed security or professional services relationship.

2. No SLA, no warranty

  • The service is provided as-is and as-available, to the maximum extent permitted by applicable law.
  • There is no SLA, no uptime guarantee, no latency guarantee, no throughput guarantee, no route availability guarantee and no support response guarantee.
  • Routes, sessions, tunnels, filters, locations, traffic limits or access may change, pause, degrade or disappear at any time.
  • Maintenance, upstream changes, abuse response, security incidents, equipment failure, configuration changes or personal availability may interrupt the service.

3. Eligibility and account responsibility

  • Access is not automatic. It depends on ASN contact confirmation, manual review and continued trust.
  • You must provide accurate account, ASN, contact, routing and network information.
  • You must control or be authorized to use every ASN, prefix, tunnel endpoint, router and contact you submit.
  • You are responsible for every packet, route, announcement, tunnel, session, user, customer and downstream network using your bgp43 access.
  • You must keep contact details reachable and respond quickly to abuse, routing, legal or operational requests.

4. Prohibited use

  • Spam, DDoS attacks, phishing and cyberattacks are prohibited.
  • Viruses, malware, botnet traffic and malicious payload distribution are prohibited.
  • Adult content sites, illegal sexual content, child sexual abuse material and any related facilitation are prohibited.
  • Tor exit nodes, anonymizing abuse infrastructure and similar high-abuse services are prohibited.
  • BGP hijacking, route leaks, unauthorized announcements and traffic interception are prohibited.
  • Scanning, brute force, credential theft, fraud, impersonation, harassment, hate content, terrorist content, sanctions evasion, copyright abuse and rights-infringing services are prohibited.
  • Any act prohibited by law, regulation, court order, administrative order, upstream policy or abuse policy in the European Union, Israel, your country, the user country, the hosting country, the transit country or any other applicable jurisdiction is prohibited.

5. Routing and fair usage

  • You may announce only prefixes you are legally and operationally authorized to route.
  • bgp43 may apply RPKI, IRR, ASPA, prefix filters, max-prefix limits, route-map controls, session limits, tunnel limits, traffic limits and other routing policy controls.
  • Invalid, hijacked, unauthorized, suspicious, dangerous or operationally harmful announcements may be rejected, filtered, blackholed, de-preferenced or removed without notice.
  • Fair usage is determined by bgp43 at its sole operational discretion and may consider traffic volume, abuse risk, capacity, cost, route quality and effect on other users.
  • You must not resell, lease, sub-allocate or provide commercial transit through bgp43 without explicit written permission.

6. Abuse handling and suspension

  • bgp43 may immediately suspend, disable, filter, blackhole, rate-limit, delete or terminate any account, tunnel, BGP session, route or traffic flow for abuse, risk, policy violation or operational need.
  • Notice is not required before emergency action, abuse response, legal compliance, upstream request handling or risk mitigation.
  • Repeated, serious or unresolved abuse may result in permanent termination and refusal of future access.
  • bgp43 may share relevant technical or account information with upstream providers, datacenters, abuse desks, security teams, RIRs, law enforcement, courts or competent authorities when reasonably necessary.

7. Logs, monitoring and privacy

  • bgp43 may monitor traffic counters, tunnel state, BGP state, route announcements, logs, abuse reports and security signals to operate and protect the service.
  • Operational data may be retained as needed for troubleshooting, security, abuse handling, accounting, legal compliance and service integrity.
  • The separate Cookies and Privacy page explains ordinary account, cookie and network data handling.
  • Do not use bgp43 if you require confidential, regulated, guaranteed or contractually protected transport.

8. User indemnity

  • You agree to indemnify and hold harmless bgp43, the operator, volunteers, helpers, sponsors, powered-by networks and upstream providers from claims, losses, costs, damages, complaints, penalties and legal expenses arising from your use of the service.
  • This includes claims related to your traffic, routes, users, customers, content, abuse, unlawful activity, security incidents, regulatory requests, IP rights, privacy violations or breach of these Terms.
  • This indemnity applies to the maximum extent permitted by applicable law.

9. Limitation of liability

  • To the maximum extent permitted by law, bgp43, the operator, volunteers, helpers, sponsors, powered-by networks and upstream providers are not liable for indirect, incidental, special, consequential, punitive or business damages.
  • This includes loss of revenue, loss of profit, loss of data, loss of routes, downtime, packet loss, latency, filtering, blackholing, reputation damage, customer claims or third-party claims.
  • If liability cannot be excluded, total aggregate liability is limited to the amount you paid to bgp43 for the service during the previous 12 months. For a free service, that amount is zero unless mandatory law requires otherwise.
  • Nothing in these Terms limits liability that cannot legally be limited or excluded.

10. Third-party networks

  • Hop179.net, AS213449.net and Lynqia are credited as main sponsors and project supporters. Lungu Stefan is credited as a transit sponsor for Amsterdam via AS205941. They are not responsible for user traffic, user routes, user content or user conduct.
  • Supporting networks may impose their own abuse, routing, security, acceptable-use or legal requirements, and bgp43 may enforce them immediately.
  • A third-party outage, policy change, takedown request or abuse decision may affect bgp43 service without notice.

11. Legal compliance

  • You must comply with all applicable laws, regulations, sanctions, export controls, court orders, administrative orders, telecom rules, cybersecurity rules, data protection rules and network policies.
  • You must not use bgp43 where your use would be illegal or would expose bgp43, the operator or supporting networks to legal, regulatory, security or reputational risk.
  • If any term is unenforceable, the remaining terms continue to apply to the maximum extent permitted by law.
  • These Terms may be updated at any time. Continued use after publication means you accept the updated Terms.
